How is data collected?
Personal information is primarily collected from our websites. When you use our websites to request product information, download software or request product support, we may request personal information in order to respond to your request. You may refuse to provide such information, but such refusal might prevent us from providing the information, product or service that you are requesting.
We may also collect personal information that you provide via email, postal mail, faxes or telephone calls. We collect personal information from third-parties that provide lists of potential prospects for our products and services. We attend events such as trade shows and conventions, in order to collect personal information from potential customers. Some types of transactions, such as purchasing our software, might require that we obtain additional personal information about you from third parties such as banks or credit reporting agencies.
What data is being collected?
Phoenix only collects information required to perform our commercial business operations. We collect “contact information” in order to communicate with our customers, prospects, affiliates and employees. This type of information may include names, titles, telephone numbers, email and postal addresses, twitter handles, social media IDs. We collect third party service provider information as may be required to support our distributors and resellers, and in support of our customers’ outsourcers, payment facilitators, and channel partners. We collect billing and transactional information, credit card data or other financial information as may be necessary to process payment transactions. Personal information may be supplemented with information you provide to us, as well as from other sources and other data appending methods, such as tracking and cookies as described below.
When you contact us via our websites or by email, your browser or email client might provide system information such as your IP address, your operating system and information identifying the type of browser or email client you are using. Some of this information, such as IP addresses, might indirectly provide additional information such as your geographic location.
Sensitive personal data
We do not intentionally collect “sensitive personal data”, other than as may be required of us in support of equal opportunity, equality and diversity monitoring and reporting. Generally, sensitive personal data relates to information concerning a data subject’s racial or ethnic origin, political opinions, religious beliefs, trade union activities, physical or mental health, sexual life, or details of criminal offenses. If we become aware that such information has been inadvertently provided to us, we will make every effort to delete such data as quickly as possible.
Privacy of children
Phoenix cares about protecting the privacy of children. We will not specifically market to or knowingly collect personal information from children under 13. Because some information is collected online, it may not appear to be the personal information of a child under 13. If we become aware that such information identifies a child under 13 we will attempt to delete the personal information as soon as possible. If you are under 13, please do not register for any of our services or provide us any information about yourself (such as your name, email address or phone number).
Cookies
Phoenix does place cookies on your computer when you access our websites. Our cookies do not contain any form of personal information and are not tracked across the web. We use cookies to manage session information when you log in to our support portal. The cookie is deleted when you close your browser. If you configure your browser to reject our cookies, you will not be able to log in to our support portal.

How secure is my data?
Your personal information is protected by physical and electronic access control mechanisms. Encryption may be used for some information, and all information is limited to those Phoenix employees and contractors who have a legitimate need for the data. For example, technical support staff have access to customer contact information in order to work with customers who have reported problems with our software. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit, and you do so at your own risk. Will the data be shared with any third parties?
Our customers may contract with third-party service providers (including outsourcers, payment facilitators, and channel partners) in the course of normal business operations with us. Additionally, we may contract with certain third-party service providers and suppliers (including distributors and resellers). We may share personal information with these service providers and suppliers, to the extent needed to deliver the services or products we support. If you are outside the United States and have initially contacted Phoenix directly, we may provide your personal information to one or more of our independent affiliates who represent Phoenix internationally.
If you are purchasing Phoenix products or services, we might provide your personal information to third parties like banks or credit reporting agencies, in order to help facilitate your transaction.
If you are purchasing a product or service from outside the United States, we might be required to provide your personal information to government agencies (such as Customs, or in support of reciprocal tax treaties, for example), in order to facilitate your purchase.

You have the right to request copies of your personal information maintained by Phoenix. (We may charge a nominal fee for providing this information.). If we have provided your personal information to a third-party, we will ask that party to provide you with copies of your information or we will provide you with that party’s contact information.
You have the right to correct any of your personal information that is incorrect.
You have the right to request that we delete your personal information that we have on file. Please note that deleting such information might inhibit our ability to provide further products, services or support.
